Conditions / Exclusions
Condition Precedent: Insured to use best endeavours to ensure that all contractors and sub-contractors carry their own Public & Products Liability Insurance for the duration of their services. Contracted service providers include (but are not limited to) security firms, amusement operators, fireworks operators, entertainers, food vendors, stall holders, labour hire, venues, sound & lighting companies etc.
The Policy excludes claims arising from crowd control or security activities provided by the insured.
The Policy excludes claims arising from fireworks and/or pyrotechnics provided by the insured.
The Policy excludes claims arising from injury to persons participating in sporting or novelty events
The Policy excludes claims arising from the service of alcohol provided by insured.
Condition Precedent: Where the insured is entitled to be indemnified by any other insurance for damages in respect of which you would otherwise be indemnifiable by us under this policy, there shall be no contribution or participation by us under this policy on the basis of any deficiency, concurrent or double insurance for such damages for which you are entitled to be indemnified by other such insurances.

Duty of Disclosure
Before You enter into a contract of general insurance with Us, You have a duty, under the Insurance Contracts Act 1984, to disclose to Us every matter that You know, or could reasonably be expected to know, is relevant to Our decision whether to accept the risk of the insurance and, if so, on what terms.
You have the same duty to disclose those matters to Us before You renew, extend, vary or reinstate a contract of general insurance.
Your duty however does not require disclosure of matter -
That diminishes the risk to be undertaken by Us;
That is of common knowledge;
That We know, or, in the ordinary course of Our business, ought to know;
As to which compliance with Your duty is waived by Us.
The policy contains the following provision in relation to Non-disclosure
If You fail to comply with Your duty of disclosure, We may be entitled to reduce Our liability under the contract in respect of a claim or may cancel the contract.
If Your non-disclosure is fraudulent, We may also have the option of avoiding the contract from its beginning.
